Opportunity Scholarships constitutional

The North Carolina Supreme Court released its ruling today in Hart v. State, the case which tests the constitutionality of opportunity scholarships — also known as vouchers. 

In a 4 to 3 ruling, the court reversed the decision of a lower court and said the program is constitutional, giving the state a green light to continue sending students to private schools using state funds.

“Our constitutionally assigned role is limited to a determination of whether the legislation is plainly and clearly prohibited by the constitution. Because no prohibition in the constitution or in our precedent forecloses the General Assembly’s enactment of the challenged legislation here, the trial court’s order declaring the legislation unconstitutional is reversed,” the decision stated.
